Abstract

This paper studies the use of court fees on judicial litigation, which aims both to regulate access to courts and reduce the congestion of the judicial system, and cover part of the direct costs of the system. Moreover, it provides resources to finance the administration of justice, and enables equitable access to the court.

Assuming that the demand for legal services is not different of the demand for any other good or service, the paper show a simple model to explain why and under what conditions it is efficient to charge a court fee.
